General Terms of Use

1. Provision of General Data and Information

FCI shall endeavour to ensure that the information and data contained on its website are correct. A liability or guarantee for the validity, correctness, and completeness of the information and data provided, however, is excluded. This also applies to all other websites to which reference is made by means of hyperlinks. FCI is not responsible for the content of any websites accessed via such links. FCI reserves the right to modify or amend the information or data provided without prior notice.

2. Liability

FCI shall not be held liable for the availability or trouble-free functionality of the services offered by associated companies under FCI.de. Nor shall FCI assume any responsibility or liability for compliance of the services offered by associated companies under FCI-net.de with the statutory provisions. Any liability for acts performed by associated companies is excluded.

As far as the services offered by FCI itself are concerned, the General Terms of Business of the FCI group companies offering the services shall apply, which are available at the relevant sites.

Moreover, FCI shall only be held liable – regardless of the legal grounds – including unlawful acts – in the event that

• legal representatives or executives of FCI cause a damage by gross negligence or wilful intent or culpably violate an obligation that is essential to the contract (cardinal obligation) in a manner endangering the purpose of the contract

or

• agents of FCI who are not legal representatives or executives violate an obligation that is essential to the contract (cardinal obligation) by gross negligence or wilful intent in a manner endangering the purpose of the contract.

Should legal representatives or executives of FCI negligently violate a cardinal obligation, the liability on the part of FCI shall be limited to such typical damage which at the time of drawing up the contract was reasonably foreseeable for FCI.

FCI’s liability pursuant to the Product Liability Act and other coercive statutory provisions shall remain unaffected by the aforementioned limitations of liability. Apart from the aforesaid, any liability on the part of FCI is excluded.

We do not warrant or represent that the prices for products and services indicated at FCI-net.de are correct.


3. Copyright

The contents of the FCI Website are protected by copyright. The reproduction of information or data, in particular the use of texts, text passages or image material, shall require the prior consent by FCI GmbH. The text and image material expressly offered for distribution in the section “Press Forum” is excluded from this clause.


4. Applicable Law

All information or data, their use, and the registration for FCI websites as well as any action, sufferance, or omission in connection with the FCI websites shall be governed exclusively by German law. The place of jurisdiction is Mülheim.


FCI on Data Protection

The security of personal data such as name, address, telephone number or e-mail address is a matter of particular concern to us. Therefore, we conduct or web activities in compliance with the applicable laws on data protection and data security. Below you will find information on which data we may collect and how it is handled.


1. Personal Data

As a general rule at FCI, the protection of your personal data is of prime importance to us. Therefore, we will not collect any personal data via our websites without your consent. You alone decide whether or not you wish to allow us access to this data, e.g. within the framework of a registration, survey, or similar. We generally use your personal data to answer your enquiry, process your order, or enable you to access specific information or offers. With a view to maintaining customer relations, it may also be necessary for us to store and process your personal data, and, for example, communicate it to our group companies to enable us to better cater to your needs or to improve our products and services; or to use this data (or for a third party to use this data on our behalf) to inform you of FCI offers that may benefit your business or to conduct online surveys enabling us to better comply with your requirements. Data not required is deleted immediately.

Of course we respect your wish should you not agree to place your personal data at our disposal for the purpose of promoting our customer relations – in particular for direct marketing or market research purposes. We agree not to sell your personal data to third parties nor market it in any other way.

2. Non-personal Data

When you access our websites, occasionally information is collected automatically (i.e. not by means of registration) that are not assignable to a specific individual (e.g. Internet browser and operating system used; domain name of the website from which the data originated; number of visits, average time spent on the site, pages accessed). Our group companies and we use this information to establish the appeal of our websites and to improve their content.

3. "Cookies" - Information automatically stored on your computer
